Terms of Service

Please read these terms carefully before using Docktix. By using our platform, you agree to be bound by them.

1. Acceptance of Terms

By accessing or using the Docktix platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you are entering into these Terms on behalf of a law firm or other legal entity, you represent that you have the authority to bind that entity to these Terms.

If you do not agree with any part of these Terms, you may not access or use the Service.

2. Description of Service

Docktix provides an AI-powered case management platform designed for personal injury law firms. Features include client intake automation, document generation, case management, communication tools, and financial tracking. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time with reasonable notice.

3. Account Registration

To use the Service, you must create an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

You must notify us immediately at support@docktix.com of any unauthorized use of your account. We cannot and will not be liable for any loss resulting from your failure to safeguard your credentials.

4. Subscription and Payment

Access to the Service requires a paid subscription. By subscribing, you authorize us to charge the applicable fees to your payment method on a recurring basis. All fees are exclusive of applicable taxes.

You may cancel your subscription at any time. Cancellations take effect at the end of the current billing period. We do not issue refunds for partial billing periods except where required by law.

We reserve the right to change subscription pricing with 30 days' written notice. Continued use after the notice period constitutes acceptance of the new pricing.

5. Acceptable Use

You agree not to use the Service to: violate any applicable law or regulation; infringe the intellectual property rights of any third party; transmit malicious code or interfere with platform security; scrape, reverse engineer, or attempt to extract the source code of the Service; or use the Service to process data of individuals without appropriate legal authority to do so.

We reserve the right to suspend or terminate accounts that violate this policy.

6. Client Data and Confidentiality

You retain ownership of all client data and case information you upload to the Service ("Customer Data"). You grant Docktix a limited license to store, process, and transmit Customer Data solely as necessary to provide the Service.

We treat all Customer Data as confidential and do not access it except to provide the Service, troubleshoot issues at your request, or as required by law. Our data handling practices are governed by our Data Processing Agreement and Privacy Policy.

7. Intellectual Property

The Service, including all software, algorithms, designs, trademarks, and documentation, is owned by Docktix, Inc. and protected by applicable intellectual property laws. These Terms do not grant you any rights in the Service other than a limited, non-exclusive license to use it in accordance with these Terms.

Any feedback, suggestions, or ideas you provide regarding the Service may be used by Docktix without restriction or compensation to you.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Docktix does not warrant that the Service will be uninterrupted, error-free, or free of harmful components. The Service is not a substitute for professional legal advice.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DOCKTIX AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE FEES PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to defend, indemnify, and hold harmless Docktix and its affiliates from any claims, liabilities, damages, judgments, and expenses — including reasonable attorney's fees — arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any dispute arising from these Terms or the Service shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in a court of competent jurisdiction.

12. Changes to These Terms

We may revise these Terms from time to time. We will provide at least 14 days' notice of material changes via email or a prominent notice on the platform. Continued use of the Service after the effective date of changes constitutes acceptance of the revised Terms.
